Patents And Designs
A patent is an exclusive right granted for an invention, which is a product or a process that provides a new way of doing something, or offers a new technical solution to a problem. The limited monopoly right granted by the state for a period of 20 years enables an inventor to prohibit another person from manufacturing, using or selling the patented product or from using the patented process, without permission.

DESIGNS
Designs are also an important component of intellectual property rights, which are worthy of protection. “Design” indicates any aspect of the features of shape, configuration, pattern or ornament applied to any article by any industrial process, whether external or internal to the whole or part of an article. A new or novel design can be registered as per the provisions of the Designs Act and such registration gives the proprietor a copyright in the design for five years, which can be renewed for two further terms of five years each.
Registration of a novel design gives the owner a right to prevent the manufacture and sale of articles of a design similar to a registered design and therefore, preserves the commercial gain resulting from customers preferring the appearance of articles which have new and innovative designs exclusively for the owner. An action for infringement can be brought against the person infringing the particular design.
Kamakshi Law Associates assists clients in obtaining registrations for their novel designs and also in litigation matters concerning infringement of designs in various courts of India.
